Can my landlord ask for two years’ rent upfront?
In Lagos State, the Tenancy Law 2011 makes it unlawful for a landlord to demand or receive more than one year’s rent in advance for a yearly tenancy, or more than six months’ for a monthly tenancy, and a tenant who pays more can also be fined. The law doesn’t cover homes in Apapa, Ikeja GRA, Ikoyi and Victoria Island. Outside Lagos, the rules depend on the state, so check before you pay.
What the Lagos Tenancy Law says
Section 4 of the Tenancy Law of Lagos State 2011 limits how much rent a landlord can ask for in advance:
- For a monthly tenancy, no more than six months’ rent from a sitting tenant.
- For a yearly tenancy, no more than one year’s rent from a new or sitting tenant.
Both the landlord who demands more and the tenant who pays more can be fined.
Where it applies
The law covers residential homes across Lagos State, except those in Apapa, Ikeja GRA, Ikoyi and Victoria Island, where landlords can still ask for more than a year.
Outside Lagos
Other states, and the Federal Capital Territory, have their own tenancy laws, and not all of them limit advance rent in the same way. Check the law where the home is before paying more than a year, and ask a lawyer if you are unsure.
If you are asked for two years
- Ask the landlord or agent to accept one year, and point to the law if the home is covered by it.
- Get every payment in writing, with a receipt that shows the period it covers.
- If you can afford one year but not two, look for a landlord who asks for one.
